Terms and Conditions for Boat Owners/Operators
1. ACCEPTANCE AND REGISTRATION
By requesting to join as an Owner/Operator on the KingYacht Los Cabos platform, you fully accept these terms. Registration is subject to administrative approval.
2. OWNER/OPERATOR OBLIGATIONS
- Valid documentation: You must have permits, insurance, and licenses required by Mexican authorities. You must keep this documentation current and available for verification.
- Truthful information: All information provided about your vessel (size, capacity, services, condition) must be accurate and up to date.
- Safety: You are responsible for passenger safety on board and must comply with all maritime safety regulations.
3. COMMISSION AND DEPOSIT SYSTEM
3.1 Platform Commission
- The Owner sets a deposit percentage (commission) between 3.5% and 45% of the total reservation price.
- This deposit serves as the platform commission when the reservation is completed successfully.
- Commission is calculated on the final public price (which includes taxes and other fees).
3.2 No-Show Policy
- If the client does not show up (No-Show), the deposit is distributed as follows:
- 80% to the Owner/Operator as compensation for the lost opportunity.
- 20% to the Platform for operational expenses and system usage.
- PayPal fees are deducted from the amount each party receives, not from the total deposit.
3.3 PayPal Fees
PayPal processing fees (approximately 3.6% + $0.30 USD per transaction) are paid by the client. These fees DO NOT affect the commission percentage you set, as they are calculated on the total amount paid by the client.
Example: If the client pays $1,000 USD, PayPal charges its fees directly to the client. You receive your net profit minus your established commission percentage, and the platform receives the deposit/commission without additional PayPal deductions (since the client paid the fees separately).
4. PRICE CALCULATION
The system automatically calculates the final public price based on:
- Base Net Profit (set by you)
- Applicable taxes
- Reservation Commission/Deposit
This calculation is shown in real time while you configure your vessel.
5. PAYMENTS AND SETTLEMENTS
- The client pays the deposit through the platform (PayPal or other enabled gateways).
- The remaining balance is paid directly to the Owner/Operator at the time of boarding, according to the payment methods you have specified.
- You must clearly indicate which payment methods you accept at boarding (cash, card, transfer, etc.).
- Payments are processed according to the agreed schedule and the terms of each payment gateway.
6. CONTENT AND GALLERY
- You must provide between 6 and 20 high-quality photographs of your vessel.
- Images must be current and accurately represent the condition of the vessel.
- The system will automatically generate optimized filenames and ALT attributes for SEO based on your vessel slug.
7. LOCATION AND CONFIDENTIALITY
- You must provide the exact location using a PIN on the map.
- This exact location is only revealed to the client after deposit payment confirmation.
- Commissions and commercial terms are confidential and must not be shared outside the platform.
8. CANCELLATIONS AND REFUNDS
- Cancellation policies must be clearly defined in your vessel profile.
- In case of cancellation by the client, the deposit is governed by the established policy.
- In case of cancellation by the Owner, the full deposit must be refunded to the client.
9. LIABILITIES AND LIMITATIONS
- KingYacht Los Cabos acts solely as an intermediary on the platform.
- The Owner/Operator is responsible for all operation, maintenance, and safety of the vessel.
- The platform is not responsible for accidents, damages, or incidents during service.
10. MODIFICATIONS AND TERMINATION
KingYacht Los Cabos reserves the right to modify these terms with prior notice. An Owner/Operator may be removed for non-compliance with these terms or platform policies.
